OBLIGATION TO USE TURKISH LANGUAGE BY TURKISH COMPANIES AND ENTERPRISES 2 December 2020

According to #Law No.805 on "#Obligation to Use Turkish Language by Commercial Enterprises", #Turkish companies are obliged to execute all #contracts in Turkish language within Turkey. However this regulation is mostly not applicable to today's commercial life considering foreign investments and projects.

Recently, 15th Chamber of Supreme Court explicitly ruled that execution of an agreement in a foreign language shall not constitute a violation of Law No.805 where the conflict involves a foreign element. In the light of above mentioned resolution of the Court of Cassation, disputes involving a foreign element in accordance with Article 2 of International Arbitration Law shall be resolved accordingly even both Parties of the Contract -that is executed in a foreign language- are Turkish.
